Terms of Service

These terms apply to your use of this website. By browsing the site or sending us an enquiry, you agree to them. If you do not agree, please do not use the site.

Who these terms are with

This website is operated by Stone Trail Ltd., trading as Stone Trail, of 1703 Welch Street, North Vancouver, BC V7P 3G9, Canada. "We", "us", and "our" mean that company; "you" means the person using the site.

Using this website

You may use this site for your own lawful, personal or business purposes — including specifying material for a project. You must be at least 13 years old to use it.

You agree not to:

  • use the site in any way that breaks the law or infringes someone else's rights;
  • attempt to gain unauthorised access to the site, its server, or any connected system;
  • introduce malware, or interfere with the site's normal operation;
  • scrape, harvest, or systematically copy our collection listings, photography, or specifications for a commercial purpose without our written permission; or
  • submit false information, or someone else's personal information without their permission.

Our content

All text, images, layouts, and other material on this site are owned by Stone Trail Ltd. or used with permission, and are protected by copyright and trade mark law. You may view, download, and print pages for your own reference — including sharing a collection page with your designer, fabricator, or installer. Any other use, such as republishing or adapting the material, needs our written permission.

Product, collection, and manufacturer names belong to their respective owners and are used to identify the material we stock. Our name, logo, and brand marks may not be used without our written permission.

Accuracy of information, and natural variation

We work to keep the information on this site correct and current, but it is provided for general information only. Slab and tile availability changes constantly, and descriptions, images, sizes, finishes, and lead times may change without notice.

Photography and screen rendering cannot reproduce a material exactly. Large-format porcelain varies in colour, veining, pattern, and finish between batches and individual slabs — that variation is inherent to the material, not a defect. Always view the actual slab or a current sample, and confirm the finished dimensions, before you commit to a purchase or cut. We offer viewings at Welch Street by appointment for exactly this reason.

Nothing on this site is professional design, structural, or installation advice for your specific project. Confirm suitability, substrate, setting materials, and installation method with your fabricator, installer, or a qualified professional before you order.

Enquiries, quotes, and contracts

Nothing on this website is a binding offer, and no part of it is an offer to sell. Prices, availability, and material shown here are indicative only, and stock shown as held may be sold or reserved before you enquire.

Submitting the enquiry form is a request for information — it does not reserve material and does not create a contract. A contract is formed only when we give you a written quote and you accept it in writing. That quote, and any terms attached to it, govern the supply of material; where they conflict with these terms, the quote wins.

Availability of the site

We aim to keep the site available, but we do not guarantee uninterrupted access. We may change, suspend, or withdraw any part of the site at any time, and we may restrict access for maintenance or for security reasons without notice.

Third-party links and services

The site links to third-party websites and embeds a map service. We do not control them, we do not endorse them by linking to them, and we are not responsible for their content, availability, or terms. Your use of a third-party service is governed by that provider's own terms.

Our liability

The website is provided on an "as is" and "as available" basis. To the fullest extent the law allows, we exclude implied warranties about the website, including warranties of merchantability, fitness for a particular purpose, and non-infringement. This section is about the website — material we actually supply to you is covered by the quote you accept and by your statutory rights.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data, or goodwill, arising from your use of this website — including any decision to order, cut, or install material made on the basis of information or photography on this site rather than on an inspection of the actual material. Where liability cannot be excluded, it is limited to the amount you have paid us, if any, in the twelve months before the claim.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Your rights under the British Columbia Business Practices and Consumer Protection Act, and any other consumer-protection law that applies to you, are not affected by these terms.

Your responsibility

If your misuse of this site, or your breach of these terms, causes us a loss or a claim from someone else, you agree to cover our reasonable costs in dealing with it.

Privacy

Our Privacy Policy explains how we handle personal information, and forms part of these terms.

Changes to these terms

We may update these terms. The version on this page at the time you use the site is the one that applies, and the date at the top shows when it was last revised. Continued use after a change means you accept the updated terms.

Governing law and disputes

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, and any dispute will be dealt with by the courts of the Province of British Columbia — except that, if you are a consumer, you keep the right to bring a claim in the courts of the place where you live, and the mandatory consumer-protection laws of that place still apply to you.

Before starting a formal dispute, please contact us — most issues are resolved with a phone call.

General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. These terms, together with any written quote, are the whole agreement between us about your use of this site.
